These Terms of Service (“Terms”) govern your use of earninger.com (the “Service”), operated by Ealizon LLC (“Earninger,” “we,” “us,” or “our”), a Wyoming limited liability company at 30 N Gould St Ste R, Sheridan, WY 82801, United States. By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use Earninger. One account is permitted per person; duplicate accounts may be merged or terminated at our discretion.
2. How Cash Back Works
When you click through to a participating store from Earninger while logged in, your subsequent qualifying purchase may earn cash back at the rate shown on that store’s page at the time of your click. Rates are set by our retail partners and can change at any time without notice — we take reasonable care to keep displayed rates accurate but do not guarantee them, and we are not liable for a rate that changed between your click and the retailer confirming your order.
Cash back starts as Pending once we receive a tracked transaction, and becomes Approved once the retailer confirms the sale — this can take 30 days or more. If your order is returned, cancelled, or the retailer otherwise reverses the commission, the associated cash back will be declined and forfeited, even if it already showed as Pending or Approved.
Your purchase contract is with the retailer, not with Earninger. We are not a party to that sale and are not responsible for the retailer’s pricing, shipping, product quality, or customer service. The cash back amount credited to your account is based solely on the commission data reported to us by the retailer or its tracking network — we pass that figure through and cannot independently verify or increase an amount a retailer reports as final.
Tracking requires being logged in and clicking through Earninger’s own tracked links (not a third-party or advertising link) immediately before completing your purchase in the same browser session. We are not liable for cash back that fails to track because of an ad blocker, a cleared cookie, or a purchase completed outside the tracked session.
3. Withdrawals
Approved cash back and points may be withdrawn, in U.S. dollars, to your PayPal account once you meet the minimum withdrawal threshold shown in your account. You are solely responsible for providing the correct PayPal email address — we are not liable for a payment sent to an address you entered incorrectly or no longer control. We are not a money transmitter: Earninger pays out its own earned affiliate commission as a rebate to you — we do not hold or transmit funds on behalf of any other party. You are responsible for any tax reporting obligations arising from amounts we pay you.
4. Referral Program
Earninger’s referral program pays $5 to you and $5 to the friend you refer once your friend’s account meets the eligibility requirements shown on the referral page (currently: their first order reaches Approved status). Limits: up to 15 successful referrals per 30-day period per account. Self-referrals, fake accounts, and referrals generated through paid advertising, coupon/deal aggregator sites, or any other commercial promotion without our prior written consent are not eligible and may result in forfeiture of the bonus and termination of the account. If you are referred by a friend, they will be able to see your signup date, your username, and whether your account has reached the threshold required for their bonus — no other account details are shared with them.
5. Points and Bonus Offers
Points earned through bonus offers (surveys, sign-ups, and similar third-party offers) are credited to your Earninger wallet under the same terms as cash back and are subject to the same Pending/Approved/Declined lifecycle, set by the offer provider, not by us.
6. Ratings, Coupon Votes, and Other Content You Submit
You’re responsible for anything you post — a store rating, a coupon “worked/didn’t work” vote, or a missing-cashback claim. Don’t post anything false, abusive, or intended to manipulate a store’s rating. We may remove content or suspend accounts that violate this. By submitting a rating or other content, you grant Earninger a worldwide, royalty-free, non-exclusive license to display, reproduce, and distribute that content on the Service. If you believe content on Earninger infringes your copyright, email support@earninger.com with the details; a formal DMCA takedown process and registered agent are being put in place.
7. Account Termination
We may suspend or terminate your account at any time, with or without notice, for any reason or no reason, including but not limited to suspected fraud, abuse, violation of these Terms, or extended inactivity (a “dormant” account).
Where termination is for suspected fraud or abuse, any unclaimed balance may be forfeited to the extent permitted by applicable state law. Where we terminate your account for any other reason, we will pay out your Approved cash back balance above the applicable minimum withdrawal threshold.
8. Disclaimers and Limitation of Liability
THE SERVICE IS PROVIDED “AS IS.” WE DO NOT GUARANTEE UNINTERRUPTED ACCESS, THE ACCURACY OF ANY DISPLAYED CASHBACK RATE OR COUPON CODE, OR THAT ANY GIVEN TRANSACTION WILL TRACK SUCCESSFULLY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, EARNINGER’S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM YOUR USE OF THE SERVICE IS LIMITED TO THE UNPAID CASH BACK BALANCE IN YOUR ACCOUNT AT THE TIME OF THE CLAIM.
9. Indemnification
You agree to defend and indemnify Earninger against any claim, loss, or expense (including reasonable attorneys’ fees) arising from your violation of these Terms, your misuse of the Service, or content you submit.
10. International Use & Sanctions Compliance
Earninger is open to users outside the United States, but you may not access or use the Service from a country or region subject to U.S. trade sanctions, or if you are on a U.S. government restricted-party list. We may request identity verification to confirm compliance and may hold accrued cash back while doing so.
11. Governing Law & Disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of the Service will be resolved exclusively in the state or federal courts located in Wyoming, and you consent to personal jurisdiction there.
12. General Provisions
Severability. If any part of these Terms is found unenforceable, the rest remains in full effect. Entire Agreement. These Terms, together with the Privacy Policy, are the entire agreement between you and Earninger regarding the Service. No Waiver. Our failure to enforce any part of these Terms is not a waiver of our right to do so later. Assignment. We may assign these Terms in connection with a merger, acquisition, or sale of assets; you may not assign your account or these Terms to anyone else.
13. Changes to These Terms
We may update these Terms as the Service changes. Continued use after an update means you accept the revised Terms.
